First and foremost, thank you for joining us at Envision this year. We hope that you have an amazing time and that you take the time to contribute to other people having an amazing time.
As a consideration for being allowed entry and to participate in the 2026 Envision Festival (the “Event” or “Envision”) produced by Producer Landing Achiote, S.A., a Costa Rica company, and its affiliates(collectively, “Producer”, “Company,” “we”, or “us”), the person purchasing the Pass (the “Purchaser”) and the person holding the Pass (the “Pass Holder”) agree to comply with any and all rules, regulations, terms, and conditions of Producer and of the Event, including but not limited to all of the terms outlined in this document. (References herein to “Visionary” or “You” or “you” shall refer to Purchaser and Pass Holder as applicable.) The terms and conditions (these “Terms and Conditions”) set forth herein apply to the Event and to this website or any other websites and web pages operated by Producer (the “Sites”).By purchasing a Pass and/or vehicle pass, attending the Event, or entering any Event facility, venue, or premise, Visionary agrees to these Terms and Conditions.
Passes and/or wristbands (collectively, “Passes”) sold through this website or the Event’s official Pass service provider’s websitegrant to Visionary a revocable license to attend the Event that may be revoked at any time for any reason. Resale or attempted resale of any issued Passand/or vehicle pass at a price higher than the face value is grounds for cancellation without compensation. The terms of the sale of each Pass and/or vehicle pass issued pursuant to a transaction initiated on this website or the Event’s official Passing service provider’s website are subject to any and all terms imposed by Producer. To be admitted to the Event, each attendee must present the wristband in its original, undamaged, unaltered form to the venue at the appropriate time. Entry may be refused for various reasons, including but not limited to misconduct, intoxication, possession of prohibited items, violent or aggressive behavior.
If Purchaser is obtaining Passes and/or vehicle passes for, or providing any Passes and/or vehicle passes to, any other person(s), the Purchaser recognizes that they are acting as that person’s agent in obtaining the Passes and/or vehicle passes, and due to this agency relationship, Purchaser agrees to these Terms and Conditions on behalf of any person(including, without limitation, any Pass Holder) to whom Purchaser delivers any of the Passes and/or vehicle passes they have obtained, and the Purchaser shall notify any such person of these Terms and Conditions when they deliver a Passand/or vehicle pass to that person. If Visionary has obtained a Pass and/or vehicle pass from another person, Visionary agrees to these Terms and Conditions when the Pass and/or vehicle pass is delivered to them.
VISIONARY EXPRESSLY ASSUMES ALL RISK AND DANGER ARISING FROMOR INCIDENTAL TO THE EVENT FOR WHICH THE TICKET IS ISSUED, WHETHER SUCH RISKSOCCUR PRIOR TO, DURING, OR SUBSEQUENT TO THE ACTUAL EVENT. VISIONARY EXPRESSLYRELEASES PRODUCER AND THE EVENT’S FACILITY, VENUE, PREMISE, MANAGEMENT,PROMOTERS, PARTICIPANTS, PERFORMERS, ARTISTS, AND THE TICKETING SERVICESPROVIDER (collectively “Management”) AND ALL OF THEIR RESPECTIVE OWNERS,OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AND AGENTS (collectively,the “Released Parties”) FROM ANY AND ALL CLAIMS THAT THE VISIONARY HAS OR MAYHAVE THAT ARISE FROM OR ARE INCIDENTAL TO THE EVENT, INCLUDING ANY CLAIMSARISING OUT OF THE NEGLIGENCE OF ANY RELEASED PARTY. THE VISIONARY KNOWINGLYAND VOLUNTARILY ASSUMES ALL RISK OF PROPERTY LOSS, PERSONAL INJURY, SERIOUSINJURY, OR DEATH, WHICH MAY OCCUR BY ATTENDING THE EVENT, AND HEREBY FOREVERRELEASES, DISCHARGES, AND HOLDS PRODUCER HARMLESS FROM ANY CLAIM ARISING FROMSUCH RISK, EVEN IF ARISING FROM THE NEGLIGENCE OF PRODUCER OR FROM THIRDPARTIES, AND THE VISIONARY ASSUMES FULL RESPONSIBILITY AND LIABILITY FOR THEIRPARTICIPATION.
VISIONARY EXPRESSLY ASSUMES ALL RISK AND DANGER ARISING FROMOR INCIDENTAL TO THE EVENT, WHETHER SUCH RISK OR DANGER OCCURS PRIOR TO,DURING, OR SUBSEQUENT TO THE ACTUAL EVENT AND ASSUMES FULL RESPONSIBILITY ANDLIABILITY FOR THEIR ATTENDANCE AT AND PARTICIPATION IN THE EVENT.
VISIONARY ACKNOWLEDGES, UNDERSTANDS AND AGREES THAT THAT THEEVENT IS AN INTERACTIVE EVENT AND THAT, AS A PARTICIPANT THEREIN, VISIONARY MAYENGAGE IN ACTIVITIES THAT INVOLVE A SUBSTANTIAL RISK OF PERSONAL INJURY,PROPERTY LOSS AND/OR ECONOMIC LOSS. These risks may include, but are notlimited to, those caused by, arising out of or in connection with: (1) theactions or inactions of VISIONARY and others; (2) conditions of the Venue,premises or equipment used; (3) conditions of attendees, participants, performers,and artists; (4) art sculptures; (5) fire and flame effects; (6) staging; (7)insects, ticks, reptiles or other wildlife; (8) the ocean, swimming, wateractivities; (9) vehicular traffic; (10) due to weather or other conditions, thefloors and/or Event grounds may in whole, or in part, slippery and/or (11)infection by COVID-19 or any other communicable disease or illness, or abacteria, virus, or other pathogen. VISIONARY further acknowledges and fullyunderstands that there may also be other risks that are presently unknown orunforeseeable.
WARNING: THE EVENT USES SPECIAL EFFECTS, WHICH MAY BECONSIDERED DANGEROUS, PARTICULARLY TO PERSONS THAT ARE PREGNANT OR SUFFER FROMCERTAIN CONDITIONS, SUCH AS EPILEPSY OR PHOTOSENSITIVITY. By entering theEvent, You acknowledge and agree that You may be subject to extremely loudmusic and sounds, as well as special effects, including, but not limited to,laser lights, strobe lights, flashing lights, a variety of light emittingdiodes ("LED"), rapidly changing or alternating images, and use ofsmoke, fog, and pyrotechnics (collectively, the "Special Effects") atthe Event. You assume all risks of any property damage or personal injuriesincluding, but not limited to, hearing loss, seizures and other healthconditions incidental, relating to, or arising from extremely loud music andsounds, and the Special Effects, whether occurring prior to, during, orsubsequent to, the Event. If You are experiencing a negative reaction to theSpecial Effects, please locate medical personnel immediately.
VISIONARY KNOWINGLY AND FREELY ASSUMES ALL RISK OF LOSS,INJURY OR DEATH CAUSED BY, ARISING OUT OF OR IN CONNECTION WITH THE EVENT
VISIONARY expressly agrees to protect, defend, indemnify,and save the Released Parties harmless (“indemnify” meaning protect byreimbursement or payment, including attorney’s fees and expenses) with respectto any and all Claims brought by or on behalf of Pass Holder, Pass Holder’sestate, heirs, assigns, beneficiaries, spouse or partner, family members, orany other person, for any injury, damage, death, or other loss in any wayconnected with the risks listed herein or attendance at or participationin the Event, including without limitation use of any Event facility, venue orpremise (including, without limitation, the Venue), without limit and withoutregard to the cause or causes or negligence, whether passive or active, of theReleased Parties, and/or any breach by the Released Parties of any legalduty. This release and indemnity section includes, but is not limited to:third party claims, claims for personal injury or wrongful death (includingclaims related to emergency, medical, drug, and/or health issues, response,assessment, or treatment), loss of consortium, breach of contract, or any otherclaim, including claims resulting from the negligence of Released Parties,whether passive or active, related to the Event.
IN NO EVENT WILL THE COMPANY PARTIES OR THEIRSUPPLIERS, ADVERTISERS AND SPONSORS, BE RESPONSIBLE OR LIABLE TO YOU OR ANYONEELSE FOR, AND YOU HEREBY KNOWINGLY AND EXPRESSLY WAIVE ALL RIGHTS TO SEEK,DIRECT, INDIRECT, EXEMPLARY, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIALDAMAGES OR LOST PROFITS, REVENUES OR BUSINESS OPPORTUNITIES, OR OTHER DAMAGESOF ANY TYPE, AND ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED,ARISING OUT OF, OR IN CONNECTION WITH, THE EVENT OR ANY PRODUCT OR SERVICE PURCHASED AT THEEVENT, EVEN IF THE COMPANY PARTIES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCHDAMAGES, AND REGARDLESS OF WHETHER THE CLAIM IS BASED UPON ANY CONTRACT, TORT,OR OTHER LEGAL OR EQUITABLE THEORY. WITHOUT LIMITING THE FOREGOING, YOUEXPRESSLY ACKNOWLEDGE AND AGREE THAT THE COMPANY PARTIES WILL HAVE NO LIABILITYOR RESPONSIBILITY WHATSOEVER FOR (a) ANY FAILURE OF ANOTHER ATTENDEE OF THEEVENT TO CONFORM TO THESE RULES, (b) PERSONAL INJURY OR PROPERTY DAMAGE OF ANYNATURE WHATSOEVER, WHETHER ARISING IN CONTRACT OR IN TORT, RESULTING FROM YOURATTENDANCE AT THE EVENT, (c) ANY ERRORS, MISTAKES, INACCURACIES OR OMISSIONS INANY CONTENT, OR (d) ANY LOST, STOLEN OR DAMAGED PASSES, OR FAILURE OF EVENTSTAFF OR SECURITY TO HONOR YOUR PASS YOUR SOLE AND EXCLUSIVE REMEDY FORDISSATISFACTION WITH THE EVENT IS TO LEAVE THE EVENT. THE LIMITATIONS IN THISPARAGRAPH WILL APPLY EVEN IF ANY LIMITED REMEDY FAILS ITS ESSENTIAL PURPOSE.THE ALLOCATION OF RISK BETWEEN US IS AN ESSENTIAL ELEMENT OF THE BASIS OF THEBARGAIN BETWEEN US. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATIONOF DAMAGES, SO THESE MAY NOT APPLY TO YOU. IN SUCH CASES, THE COMPANY PARTIES'LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. INNO EVENT WILL ATTORNEYS' FEES BE AWARDED OR RECOVERABLE BY YOU.
ALLSALES ARE FINAL. NO REFUNDS WILL BE GRANTED FOR ANY REASON. EVENT DATE AND TIMESUBJECT TO CHANGE. ALL RIGHTS RESERVED. IF THE EVENT FOR WHICH ANY PURCHASEDTICKET AND/OR VEHICLE PASS IS RESCHEDULED OR CANCELED, THE VISIONARY SHALL NOTBE ENTITLED TO A REFUND EXCEPT AS OTHERWISE REQUIRED BY LAW. INSTEAD, THEVISIONARY SHALL HAVE THE RIGHT, EXCEPT AS OTHERWISE PROVIDED, (1) IF THE EVENTIS RESCHEDULED TO A DATE AND TIME WITHIN THIRTEEN MONTHS OF THE DATE AND TIMEORIGINALLY SCHEDULED, TO USE THE PASS AND/OR VEHICLE PASS TO ATTEND THE EVENTAT THE RESCHEDULED DATE AND TIME, OR (2) IF THE EVENT IS NOT RESCHEDULED WITHINTHIRTEEN MONTHS OF THE DATE AND TIME ORIGINALLY SCHEDULED, TO EXCHANGE THE PASSAND/OR VEHICLE PASS TO ANOTHER EVENT THAT IS DESIGNATED BY MANAGEMENT AS THEOFFICIAL REPLACEMENT EVENT FOR THE CANCELLED EVENT. The Pass and/or VehiclePass is not subject to any refund, bears no cash value, and is not redeemablefor cash. Artists and set times are subject to change without notice. The Passand/or vehicle pass is not subject to exchange except as expressly providedabove. If issued as a complimentary Pass or Vehicle Pass, the Pass or VehiclePass is not exchangeable or redeemable for another ticket or pass to or for anyother event or performance or for any other consideration, present or future,monetary or otherwise. Passes and/or Vehicle Passes obtained from unauthorizedsources may be counterfeit and worthless. Pass or Vehicle Pass cannot bereplaced if lost, stolen, or destroyed, and are valid only for the Event forwhich they are issued. It is unlawful to reproduce any ticket and/or vehiclepass in any form.
YOU AGREE TO NOT FILE A CHARGEBACK OR ANY TYPE OF PAYMENTREVERSAL FOR ANY REASON.
Producer is not liable for acts of God, acts of nature,weather, fires, floods, strikes, labor stoppage, protests, riots or civilcommotion, terrorism or other hostilities, epidemic, pandemic (includingwithout limitation the COVID-19 pandemic), widespread plague or disease, travelbans or restrictions, sanctions, quarantine restrictions, or acts, orders,rules or regulations of any government or governmental agency (whetherdomestic, federal, national, state, or local), or any other acts, matter, or things,whether or not of a similar nature, which are beyond the control of Producer.Tickets and vehicle passes are non-refundable even if the Event is terminatedearly or canceled, or entry conditions are modified, due to harsh weather, actsof nature, pandemic, governmental regulation, the failure to obtain requiredgovernmental permits, conditions beyond Producer’s control, or any other forcemajeure event described above. Management reserves all rights not expresslygranted to the Visionary by these terms.
If the Event is canceled in whole, or in part, due to aForce Majeure Event (as defined below), You will not be entitled to a refund.You understand that in all instances, the maximum remedy You may receive forany cancellation of any part of the Event, if any, will be the face value ofYour Pass, excluding all fees, taxes and/or service charges paid by You inconnection with the purchase of Your Pass.
The following items are prohibited inside the Event venue,facility, and premises: pets or animals of any kind with the exception ofregistered service animals cleared by Producer, unmanned aerial vehicles (UAVs)or drones of any size, guns or weapons of any kind, fireworks or explosives,laser or handheld laser pointers, any drugs classified as illegal by the localmunicipality, Costa Rica, its federal government, and any other item Managementdeems to be inappropriate for the Event or that may present a potential safetyrisk.

The use of drones is specifically prohibited at the Event.Visionary agrees to be bound by the terms of the Event’s following DronePolicy: “To ensure the safety and enjoyment of all Management, attendees,artists, and staff, Producer strictly prohibits the operation of or use of anyunmanned aerial vehicles (UAVs), also known as drones, on, from, or above anyand all Event premises, facilities, venues, activities, or events withoutspecific written permission from Producer. This includes all UAVs regardless ofsize, weight, or purpose. If you are found to be using or in the possession ofa UAV or Drone while at the Event, it will be confiscated by Event staff andheld for the remainder of the Event.”If You bring any of the items on the above prohibited itemslist into the Event, such items will be confiscated and discarded and You willbe subject to removal from the Event based on the sole discretion of Company.Under no circumstances will Company hold any prohibited items for You.
Visionary acknowledges that people will be using film,video, and photographic cameras at the Event, and that the Visionary’s imagemay be captured on film, video, or photographs that may subsequently bedisplayed or disseminated without Visionary’s consent or payment ofcompensation to Visionary, and the Visionary releases each of the ReleasedParties from any liability due to such capturing, display, or dissemination.
Pass Holder agrees to the following terms, conditions, andguidelines for the use of any imagery obtained at the Event, including stillphotographs and videos (hereinafter “Event Imagery”). Pass Holder may only useEvent Imagery for “Personal Use,” defined to include: (1) sharing with friendsand family; (2) displaying on personal websites (as long as the website doesnot sell any product or service, and does not purport or appear to be anofficial website of the Event or Producer); and (3) displaying on socialnetworking platforms, such as Instagram and Facebook (as long as the display ofthe Event Imagery on these sites is not commercial or promotional in any mannerand the social media account is not affiliated with any commercial enterprise).
PASS HOLDER UNDERSTANDS AND ACCEPTS THAT PASS HOLDER MAY NOTMAKE ANY USE OF EVENT IMAGERY WITHOUT PRIOR WRITTEN PERMISSION FROM PRODUCER,OTHER THAN PERSONAL USE AS DEFINED ABOVE. Pass Holder understands that PassHolder has no right to sell, transfer, license, sublicense, or give EventImagery to any other party, except for Personal Use, and agree to inform anyoneto whom Event Imagery is given that it can only be used for Personal Use.
Pass Holder acknowledges that people, including Producer,will be using film, video, and photographic cameras at the Event, and that thePass Holder’s image, voice, likeness, and/or appearance (collectively,“Personal Likeness”) may be captured or embodied in a fixed medium of somefashion, including, but not limited to, photographs, film, video, recordings,audio tapes, digital images, digital audio, or other video or audio recordingstaken or made of Pass Holder during the Event (collectively, as the same may bemodified, adapted, altered or the like, the “Materials”), that may subsequentlybe displayed or disseminated without Pass Holder’s consent or payment ofcompensation to Pass Holder, and the Pass Holder releases each of the ReleasedParties from any liability due to such capturing, display, or dissemination. Byattending the Event, Pass Holder consents to being filmed and or photographedand consents that Pass Holder’s Personal Likeness and the Materials may be usedby the Producer and Management and/or by other participants or attendees,without compensation to Pass Holder, for any purpose in any media (now known orhereafter devised) throughout the world in perpetuity, including but notlimited to use in photographs, videotapes, CDs, DVDs, broadcast, telecast, livestreams, podcast, webcast, recordings, motion pictures, commercialadvertisement, promotional materials, and/or any other record of the Event.Pass Holder understands that all copyright rights in the images shall be ownedby Producer in perpetuity and waives any inspection or approval rights.
Pass Holder hereby grants Producer and their respectiveparent, subsidiary and affiliated companies, assignees, licensees, owners,officers, directors, partners, managers, board members, shareholders, insurers,agents, staff, employees, volunteers, contractors, and representatives anirrevocable, non-exclusive, royalty-free license to use the Materials and/orthe Event Imagery taken by Pass Holder in connection with the Event and/or anyderivatives of, successors to and/or events, companies, productions and/orprojects affiliated with the Event or the Producer (collectively, “EnvisionProjects”), in all media, whether now known or hereafter devised, throughoutthe universe, in perpetuity. Such rights include, without limitation, the rightto use the Materials, in whole or in part, in and in connection with (a) thedevelopment, production and/or other exploitation of any Envision Project, aswell as all allied, ancillary, subsidiary, and derivative uses and versions ofany Envision Project, and (b) advertising, marketing, promotion and publicityin connection with the Producer, Management, the Event, the Envision Projects,the Materials and/or Event Imagery, and/or any or all allied, ancillary,subsidiary and derivative uses of the foregoing, in all media, whether nowknown or hereafter devised, throughout the universe, in perpetuity, at noadditional cost. Pass Holder irrevocably waives any right to inspect or toapprove any Materials, whether or not any of the foregoing may be created usingor includes or embodies Pass Holder’s Personal Likeness, and waive any Claimwith respect to the eventual use thereof. Furthermore, Pass Holder HEREBY UNCONDITIONALLY AND IRREVOCABLY RELEASES, FOREVER DISCHARGE AND HOLD HARMLESS the Released Parties from any and all Claims caused by, arising out of or inconnection with such use including, without limitation, any and all Claims for invasion of privacy, infringement of Pass Holder’s right of publicity, defamation (including libel and slander), and any other personal or propertyrights.
All Passes, including international purchases, will be picked up at Will Call at the Event without exception. Tickets will never be available at Producer’s offices.
For any Pass or Vehicle Pass sale or sale registration, if for any reason whatsoever, including computer or software malfunction, mistake or inadvertence, network congestion or crashes, Visionary is not able to purchase any Pass or Vehicle Pass through the sale process, or Visionary’s registration for a sale or the purchase of Pass or Vehicle Pass is not processed, or Visionary receives a notice that Pass or Vehicle Pass purchase or ticket registration is rescinded, revoked, canceled, or made in error and Visionary’s credit card payment is credited to Visionary’s credit card account, Visionary waives any claim against each of the Released Parties and holds harmless and releases each of the Released Parties from any and all liability.
Pass and Proof of Identification Required for Entry
In order to enter into the Event, each Visionary must havetheir own valid Pass. One (1) Pass is required per attendee and will only bevalid on the day(s) of the Event and area(s) of the Pass as indicated on thePass.
Your Pass is not redeemable for cash. There will be noreplacements for Passes that are lost, stolen, destroyed or damaged and youunconditionally accept the risk of damage to, loss of and/or theft of YourPass. Your Pass is intended for You only. In no instance shall You share YourPass with any person(s) attending or attempting to attend the Event. If You arediscovered to be sharing Your Pass with another person(s), Company reserves theright, in its sole discretion, not to grant You access to the Event or ejectYou from the Event.
To ensure that Your Pass is valid, purchase Your Passes fromProducer or any other Company-authorized sale channels listed on the officialCompany website, located at www.envisionfestival.com. Passes from unauthorizedsales channels (e.g., scalpers) may be forged. In no event will forged ticketsbe honored or eligible for a refund.
If you purchase your Pass using the installment plan option,then your purchase will be subject to the installment plan terms andconditions.
If You have any questions or concerns regarding ticketingfor the Event, including, but not limited to, payment plans, please contactcustomer support by e-mailing info@envisionfestival.com.
You must submit Your Pass for validation upon entry into theEvent.
You must have one of the following forms of approvedidentification to enter the Event that demonstrate proof of age. No exceptionswill be made, even if You are accompanied by an adult or a person with valididentification. Failure to provide valid identification shall preclude You fromentering the Event and You shall not be entitled to any refund nor will You beentitled to, or will the Company be liable for, any other damages, including,but not limited to, incidental and/or consequential damages. In addition,during the Event, You must be able to provide valid identification if requestedby a member of security or crew. If You are not able to show a valididentification, You may be promptly ejected from the Event without theopportunity to return to Your locker, and You shall not receive a refund ofYour Pass.
Re-Entry
If You are removed from the Event, Your ticket shall not berefunded and You will be denied re-entry, even if You are in possession of anew Pass. If You have a new Pass, Event staff may seize that Pass and You shallnot receive a refund.
Unauthorized Sale of Use of Pass
Anyone caught forging entry tickets or any other specialadmission tickets in order to access or sell such tickets to the Event will beprosecuted without exception. Counterfeit Passes will not be honored orrefunded by the Company and Your purchase of such Pass(es) is not binding onthe Company whatsoever.
Anyone caught tampering with or sharing their Pass will beimmediately ejected and banned from the Event.
Passes may not be resold without prior explicit permissionfrom the Company. Passes which appear to have been resold without permissionfrom the Company will not be honored or subject to a refund.
The resale, attempted resale, or purchase of Your Pass at aprice higher than the official purchase price from the authorized ticket agent,or other Company-authorized sale channels, is grounds for seizure andcancellation of Your Pass without compensation. The only valid Passes are thosepurchased and/or redeemed through Company-authorized sale channels listed onthe official Company website.
Passes may not be used in association with any giveaway,sweepstakes, contest or similar activities, including, but not limited to, as aprize or incentive, without the Company's prior written consent. Any Passes soused will automatically become void at the Company's sole discretion with norefund to You and/or the Pass Holder.

Management retains the right to cancel, rescind, or revokeany Pass or Vehicle Pass purchases at any time for any reason whatsoever atManagement’s sole discretion. Only Pass or Vehicle Pass orders placed throughthe Event’s official ticketing service provider’s website are guaranteed to beauthentic. Please visit the Pass or Vehicle Pass and lineup pages for PassFAQs, wristband FAQs, and other information regarding the types of Passesavailable and purchasing Pass or Vehicle Passes.
ZERO TOLERANCE DRUGS POLICY
Producer has a zero-tolerance policy regarding illegaldrugs. It is forbidden on the Event site to: (i) use, distribute, sell and/orto be in possession of illegal drugs; and (ii) distribute, sell or improperlyuse prescription or over-the-counter drugs. Visionary understands and agreesthat Visionary’s use of the Pass is contingent upon Visionary’s unconditionaland voluntary acceptance to be searched for the presence of drugs, weapons,objects that may disrupt the peace or jeopardize the safety of other ticketholders,and/or other prohibited items prior to Visionary’s admission to the Event site,and/or at any time thereafter. If any of these items are found, this licensefor admission shall be immediately revoked, such items will be seized bysecurity personnel and forfeited by Visionary, or Visionary will be immediatelyremoved from the Event. Notwithstanding the foregoing, Visionary is permittedto bring into the Event prescription drugs if Visionary has a validprescription with Visionary’s name clearly listed on the prescription.Visionary will only be allowed to carry the dosage of medication required forthe duration of the Event. If Visionary is in violation of this rule, Visionarywill be immediately ejected from the Event site. The Event staff will closelymonitor any potential illegal or prohibited drug activity, relying in part onsecurity cameras placed throughout the Event site.
Company may choose to, but shall not be required to, offeramnesty bins at the Event.
By entering the Event site, Visionary consents to besearched by Event staff. If Visionary refuses to submit to a search, Visionarywill be denied entry to, or ejected from, the Event site.
Security Check
Access to the Event site is PROHIBITED and refused to, butnot limited to, people who:
Please note all Pass Holders will be searched upon enteringthe Event site. Security guards will inspect all objects brought onto the Eventsite including, but not limited to, clothing, luggage and other personal itemsin order to detect objects that may disrupt the course of the Event, jeopardizethe safety of other ticketholders, or disturb the peace. Security guards maysearch any persons and property on the Event site at any time, including, butnot limited to, storage lockers, and confiscate any prohibited items, in theirsole discretion. Given the volume of attendees, it is not guaranteed that theseobjects will be returned to You.
Intellectual Property
Visionary acknowledges that “Envision” “Envision Festival,”and all logos and symbols associated therewith are registered trademarks ownedand/or licensed by Producer and that Producer has the exclusive right tolicense and enforce those trademarks and any other trademarks, copyrights, andother intellectual property owned or licensed by Producer, including anylikenesses, drawings, and representations of the Event (collectively, “ProducerIntellectual Property”).
WITHOUT THE PRIOR WRITTEN CONSENT OF PRODUCER, VISIONARYUNDERSTANDS THAT SUCH PERSON MAY NOT USE ANY OF PRODUCER’S INTELLECTUALPROPERTY OR EVENT IMAGERY IN ANY ADVERTISEMENT OR PROMOTIONAL MATERIAL(INCLUDING WITHOUT LIMITATION MUSIC VIDEOS OR POSTS ON THE SOCIAL MEDIAACCOUNTS OF COMMERCIAL ENTERPRISES), OR IN THE TITLE OR ON THE COVER OF ANYPUBLICATION, UNLESS THE USE IS AUTHORIZED IN WRITING BY PRODUCER.
Consent To Electronic Communication
Visionary agrees that we may provide electronically any andall communications concerning tickets and/or any payment plan entered into aswell as any disclosures required by federal or state law. Visionary’s consentapplies not only to the tickets and any payment plan but also to any ancillaryagreement related to these and to any future tickets or payment plans obtainedthrough us.
Consent To Health Rules And Medical Treatment
Visionary agrees to comply with any and all health rules,regulations, terms, and conditions of the Event, whether established byManagement, any venue or facility, or government or health authorities,including, but not limited to rules with respect to masks, social distancing,health screening activities (including COVID-19 tests), and vaccinationrequirements. Visionary will follow all instructions when entering any venue orfacility and while attending the Event, whether posted or otherwise communicatedverbally or in writing by Management staff, employees, representatives orcontractors, police, or government or health authorities. If Visionary refusesor fails to comply with any health rules, regulations, terms, conditions,and/or instructions for the Event, Visionary acknowledges and agrees thatVisionary may not be permitted to attend the Event and/or may be removed fromthe Event.
Visionary authorizes, and consents to, Management andManagement staff, employees, representatives, or contractors conducting publichealth safety screening activities by methods selected by government or healthauthorities. As a result of such public health safety screening activities,Visionary acknowledges and agrees that Visionary may not be permitted to attendthe Event.
Visionary consents to have medical treatment that may bedeemed advisable in the event of injury, accident, and/or illness during anyprogram, event, or activity at the Event. Visionary releases each of theReleased Parties and all persons participating in any such medical treatmentfrom all responsibility for any such actions.
BY ATTENDING THE EVENT OR ENTERING ANY EVENT FACILITY,VENUE, OR PREMISE, VISIONARY VOLUNTARILY ASSUMES ALL RISKS RELATED TO EXPOSURETO OR INFECTION BY COVID-19 OR ANY OTHER COMMUNICABLE DISEASE OR ILLNESS, OR ABACTERIA, VIRUS, OR OTHER PATHOGEN, AND ACKNOWLEDGES AND AGREES THAT SUCHEXPOSURE OR INFECTION MAY RESULT IN PERSONAL INJURY, ILLNESS, PERMANENTDISABILITY, AND DEATH TO YOU OR YOUR FAMILY. Visionary holds each of theReleased Parties and all persons participating in any medical treatment harmlessshould Visionary contract any illness, disease, bacteria, virus, pathogen, orany other malady while attending the Event or as a result of attending theEvent.
Family Event / Minors
Event is family-friendly and also a festival. Visionaryacknowledges that attendees under the age of 18 may be at the Event. No minorwill be allowed to enter the Event without a parent or court-designated legalguardian (paperwork must be provided to Producer proving such guardianship)over the age of 25. All minors must purchase or possess a ticket prior toentering the Event. Visionary agrees that they will be responsible at all timesfor any and all minors in their care. Visionary agrees to the contractual termscontained in this document on behalf of the minor.
Help Keep Our Site Clean
Producer strives to have the lowest possible impact on theland used during the Event. Visionary agrees to use only designated trashand/or recycling receptacles prior to, during, and after the event. Visionaryagrees under no circumstance to leave trash or recycling in the Event confinesor anywhere surrounding the venue. Please do not bring single-serve plasticbottles into our Event. Trash or recycling may not be buried, burned, ordisposed of in any body of water.
Terms Subject to Change
Visionary further understands that these Terms andConditions may be changed by Producer prior to the Event, and if so, therevised Terms and Conditions will apply to Visionary Pass Holder. Pass Holder’sattendance at the Event or entry to any Event facility, venue or premise(including without limitation, the Venue) signifies Pass Holder’s bindingagreement to the Terms and Conditions in effect at the time of Pass Holder’sentry to the Event.
Final Agreement
These Terms and Conditions shall be governed by and enforcedaccording to the laws of Costa Rica without regard to any rules relating toconflicts of laws. Visionary understands that any claim or dispute arising outof or in connection with these Terms and Conditions must be brought exclusivelyin courts located in Costa Rica, and Visionary will submit to the personaljurisdiction of such courts for the purpose of litigating all such claims ordisputes. No agency, partnership, joint venture or other relationship isintended or created by your attendance at the Event or use of the Sites. TheseTerms and Conditions contain the entire understanding of the parties withrespect to the matters contained herein and supersedes and replaces in itsentirety any and all prior communications and contemporaneous agreements andunderstandings between the parties, whether oral, written, electronic orimplied. These Terms and Conditions (including, without limitation, any and allwaivers, releases, and agreements to indemnify contained herein) are intendedto be interpreted and enforced to the fullest extent allowed by law. If anyprovision of these Terms and Conditions is held invalid or unenforceable underany circumstance, its application in any other circumstances and the remainingprovisions shall not be affected and will continue in full force and effect.Further, the provision that has been deemed to be invalid or ineffective shallbe enforced to the greatest extent permitted by law. The heading at thebeginning of each section is for reference purposes and no way defines thescope or extent of such paragraph.
